ESDC Launches New Campaign Against Driver Inc. Misclassification

In a message to industry during National Trucking Week, Employment and Social Development Canada (ESDC) noted it will continue efforts to safeguard federal labour standards by monitoring and addressing misclassification of employees in federally regulated industries, with a particular focus on road transportation.

As part of their message, ESDC announced new resources to help employers and employees understand their obligations and rights:

  1. Misclassification in the Road Transportation Industry: Awareness Kit
  2. “Misclassification: Know Your Rights” (Video)

These resources cover essential topics, including:

  • What employee misclassification is;
  • Its impacts on truck drivers;
  • Protections under the Code;
  • How to identify and report misclassification;
  • Consequences for employers who misclassify workers; and
  • Differences between employees in federally regulated industries and independent contractors.
